How Much Jail Time for a DWI Arrest?

Jail Time for First Offense DWI

For a first offense drunk driving/driving while intoxicated arrest, a person will wind up in jail for a minimum of 3 days and a maximum of 180 days.

In addition to jail time, first offenders will face fines up to $2,000 and license suspension for 90 days to 1 year.

Jail Time for Second Offense DWI

For a second offense drunk driving/driving while intoxicated arrest, a person will wind up in jail for a minimum of 30 days and a maximum of 1 year.

In addition to jail time, second offenders will face fines up to $4,000 and license suspension for 180 days to 2 years. An ignition interlock device will also be installed in the person's vehicle.

Jail Time for Third Offense DWI

For a third offense drunk driving/driving while intoxicated arrest, a person will wind up in Texas state prison for a minimum of 2 years and a maximum of 10 years. The nature of the arrest and the previous DWI offenses will determine just how long a person will remain in prison.

In addition to prison time, third offenders will face fines up to $10,000 and license suspension for 180 days to 2 years. An ignition interlock device will also be installed in the person's vehicle.

Jail Time for DWI When a Child Is the Passenger

If you are arrested for a DWI and have a child who is younger than 15 years old in your vehicle, steep fines and penalties will be applied to your charge.

For first offenses, you will spend up to 2 years in jail. First offenders in these situations will also face a fine of up to $10,000 and license suspension for 180 days.

A Note on Penalties for Minors Facing DUI Charges

Minors are not charged with driving while intoxicated but rather driving under the influence (DUI). Minors who are charged with a first offense DUI may spend between 3 days to 180 days in jail; for second offense DUI, minors may face up to 1 year in jail.
