According to the Texas Code of Criminal Procedure, if you are required to register as a sex offender, and intend to reside in a given place for more than seven days, you must alert local law enforcement. Also, if you are required to register as a sex offender and fail to do so, you may be charged with a crime. Texas laws are strict regarding individuals required to register as sex offenders. While some individuals may try to subvert or ignore the requirement, many other individuals simply misunderstand the requirements – particularly when moving to Texas from another state.

Failure to register as a sex offender is a serious crime that can further complicate your life. If the State has charged you or someone you know with failure to register, Jason Trumpler can help. Registration requirements can be complicated, and one small mistake or error can result in severe consequences. Contact our office today at 512-457-5200.

Potential Consequences

If you move or are visiting someone for more than seven days, you must report yourself as a registered sex offender to local officials. They will take a picture of you and collect general information (name, date of birth, social security number, etc.), as well as general information about the alleged offense (age of the child, date that it happened, nature of the crime, etc.).

The frequency for which you will have to report depends on the level of the violation. It is important to note that if you plea to any crime or the court sentences you as the result of any conviction, that conviction may have registration requirements attached to it. In Texas, complying with registration requirements can be complicated. If you do not register as required according to sentencing, you can be charged with failure to register as a sex offender.

Potential punishments include:

  • State Jail Felony: 6-months to 2-years in State Jail and up to a $10,000 fine.
  • 3rd-Degree Felony: 2-years to 10-years in prison and up to a $10,000 fine.
  • 2nd-Degree Felony: 2-years to 20-years in prison and up to a $10,000 fine.
  • 1st-Degree Felony: 5-years to 99-years in prison and up to a $10,000 fine.

Failure to register as a sex offender is a felony-level offense. If the State has accused you of failure to register before, or the State is charging you with using falsified information to attempt to register, the State will enhance your charge.
