Important Information About Your Killeen DWI Charge

If law enforcement has arrested you for DUI or DWI, you have 15-days from the date of arrest to contact DPS to schedule an Administrative License Review Hearing (ALR). Failure to do so will lead to the automatic suspension of your Texas driver's license. Ideally, you will hire a competent attorney during these 15 days, and he or she will schedule the hearing for you. If not, you will need to do so on your own to avoid suspension.

If DPS suspends your license as a result of a failure to schedule your ALR Hearing or as the result of an adverse ruling after your ALR Hearing, I can prepare an Occupational License on your behalf.

In the military, there are both criminal charges and conduct charges. Conduct charges can arise from specific actions committed by a member of the army even though that conduct would not be a crime in the civilian world. Criminal charges can occur when a member of the military commits a criminal act either while on-post or while off-post.

It is possible, although not very common, for a member of the military to commit an act off-post and be prosecuted both by the military and the civilian courts. While a conduct charge may not carry private consequences (such as being labeled a felon or registering as a sex offender), having a conduct charge sustained against you will, nevertheless, have significant ramifications on your career.

The military justice process is different from the civilian State and Federal court systems. In the military justice system, whether you retain private counsel or not, in most cases, you will be appointed a lawyer from the Judge Advocate General's (JAG) Corps. These court-appointed lawyers are licensed attorneys and familiar with the ins and outs of military law. It is often to your benefit to have a civilian attorney retained as well. It is essential, however, that this retained lawyer understands the inter-workings of the military to ensure that your rights are protected. If your retained lawyer does not have military knowledge, you may get pushed through the military justice system without all avenues of your defense being explored and exhausted.
