In the State of Texas, reckless driving in most cases is a misdemeanor offense that could result in fines, jail time, increased insurance rates, and a drivers’ license suspension. According to the Texas Penal Code, reckless driving is defined as driving a motor vehicle in “willful or wanton disregard for the safety of persons or property.” Basically, this means that if you are driving your car (either purposefully or not) in a way that a reasonable person would say might endanger another, you may be charged with reckless driving.

Potential Consequences

Reckless driving” is a largely subjective term left up to the police officer’s discretion. Examples of what a police officer might consider reckless driving is weaving in and out of lanes, excessive speeds, etc. Often, reckless driving is coupled with other charges like which may increase the potential penalties. Additionally, if you have previous traffic convictions, were under the influence of drugs or alcohol, or have an open container in your vehicle, the charge may be increased.

If you are convicted of reckless driving, you will have a Class B Misdemeanor on your record. A conviction of reckless driving may lead to:

A jail sentence of up to 30-days and/or
A fine of up to $200

While you may be charged with reckless driving in a driveway or parking lot belonging to a business, you cannot be charged with reckless driving if you are on private residential land or a paid parking garage or lot.
