Repeat Offenses
If a person previously convicted of a Class A misdemeanor is convicted of another Class A misdemeanor, they are sentenced to at least 90 days in county jail. If the person commits a Class B misdemeanor, the minimum sentence is 30 days in jail.Drugs
In the event that drugs were involved and used to commit the misdemeanor, Class A charges have a 180-day minimum in county jail.Bias or Prejudice
If a crime is discovered to be motivated by bias or prejudice, a 180-day minimum for Class A misdemeanors is in effect.Are You a First-Time DWI Offender?
If you are a first-time DWI offender, you may qualify for sealing your records under House Bill 3016 in Texas. Known as the “Second Chance" bill, it can make first-time DWI offenders eligible for nondisclosure, which hides your records from the public and can make it easier to find a job or housing. An order of nondisclosure does not entirely eliminate your record, as it is still visible to criminal justice agencies or the government.
In order to qualify for nondisclosure, the offender must meet the following requirements:
- Had a BAC of less than 0.14% at the time of the incident
- The offender paid all fines associated with the charge
- No one was hurt at the time of the incident
