Intoxication Assault in Texas is governed under Texas Penal Code Section 49.07.
The elements of the offense are that if the person, by accident or mistake while operating a motor vehicle in a public place while intoxicated, by reason of that intoxication causes serious bodily injury to another.
"Serious bodily injury" means injury that creates a substantial risk of death or that causes serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.
There are essentially three ways to defend these types of cases. The first way is you attack whether the driver was in fact impaired. The second way you attack this type of case is whether the accident was in fact caused by the driver's impairment and not superceding or intervening cause. The final way to attack this case is to argue that the injury suffered was not "serious" bodily injury.
