Due to concerns about human trafficking, the State is more aggressively prosecuting prostitution cases. The Travis County Attorney's Office, in particular, has devoted specific time and resources to creating specialized prostitution classes, prosecution rules, and a specialized court known as the Phoenix Court.
Prostitution in Texas is governed by Penal Code Section 43.02. It defines prostitution as knowingly offering to engage in or agreeing to engage in sexual conduct for a fee, or soliciting another in a public place to engage with the actor person in sexual behavior for hire. It is an offense whether you are the person who receives the money or pays the money for the sexual services or whether you are the person soliciting the services or offering to hire someone to perform the act.
In general, prostitution is a Class B Misdemeanor, punishable by up to 180 days in county jail and a fine not to exceed $2,000. It is a Class A Misdemeanor, punishable by up to one year in the county jail and a fine not to exceed $4,000 if the person has been convicted one or two times prior for prostitution under this section. It is a State Jail Felony, punishable by Six Months to 2 Years in the State Jail and a $10,000 fine if a person has three or more prior convictions under this statute. It is a 3rd-Degree Felony, punishable by 2 to 10 years in the Texas Department of Criminal Justice Institutional Division and a $10,000 fine if the person solicited is younger than 18 but older than 14. It is a 2nd-Degree Felony, punishable by 2 to 20 years in the Texas Department of Criminal Justice Institutional Division and a $10,000 fine if the person solicited is younger than 14 years of age.
It is a defense if the person charged with the crime is a victim of human trafficking.

I am a former prosecutor with exceptional trial experience. I graduated magna cum laude from Whittier College in 1997, with a Bachelor of Arts degree in Political Science. I obtained my law degree from the University of Texas at Austin School of Law in December 1999.
Before opening my office, I was the Supervising Attorney of the Orange County, California Office of The Law Offices of Myles L. Berman. This firm specializes in drunk driving defense. Before working for the Law Offices of Myles L. Berman, I spent three years working for the Orange County District Attorney's Office.
During my tenure with the Orange County District Attorney's Office, I handled thousands of criminal cases at both the pre-trial and trial stage. Also, I trained law enforcement officers throughout Orange County. I also previously worked with the Ventura County District Attorney's Office as a Deputy District Attorney. In that capacity, I also handled hundreds of cases. While at both of these offices, I worked a significant number of prostitution and vice cases.
Over my career, I have taken well over 100 jury trials to verdict. I concentrate my practice in defending people accused of crimes, including prostitution-related crimes and sex offenses, throughout Central Texas.
I have been licensed to practice law in the State of Texas (Bar # 24053913) since 2006 and the State of California (Bar # 210564) since 2000. In 2005, I began practicing before the United States District Court, Central District of California. In 2011 and 2012, I also started practicing before the United States District Court, Western District of Texas, the United States District Court, Eastern District of Texas, the United States District Court, Northern District of Texas, and the United States District Court, Southern District of Texas.

Additionally, I am a proud veteran of the United States Army. I received my Honorable Discharge in April of 2003. I served my country from 1995 to 1996 as a peacekeeper in the former Yugoslavian Republic of Bosnia. In my spare time, I enjoy spending time with my four sons, reading, and traveling.
