The Penalties of BWI

Section 49.06 of the Texas Penal Code governs the offense of boating while intoxicated. As a class B misdemeanor, BWI is punishable by a fine of up to $2,000 and/or jail time up to 180 days for a first offense. Convicted individuals may also face license suspensions and surcharges.
