Prostitution and Other Sex Crimes Carry Serious Consequences

Participating in sex acts in a brothel, asking a woman for sex in exchange for money, and other related crimes are typically considered misdemeanors. Similarly, a man or woman charged with being a prostitute in Austin for the first time will be charged with a misdemeanor. They might face up to 180 days in jail, a fine of up to $2,000, or both. If you were charged as a prostitute, you might also be put on probation, need to complete community service, and attend AIDS education classes.

The Laws Against Solicitation in Texas Have Grown More Severe

The challenges of the legal system are ever-growing. As of September 2021, the way that the state of Texas uniformly addresses accused solicitors has changed. This shift is due to HB1540, a bill targeting those who are charged with or accused of soliciting sex from a prostitute.

HB1540 makes soliciting a felony as opposed to a misdemeanor for first-time offenders. While this new law does not work retroactively, it does impact any charges in Texas after it was put into place.
