The Legal Definition of Driving While Intoxicated
You can be charged with DWI if you are intoxicated while operating a motor vehicle in a public place. In Texas, a person is legally intoxicated when their blood alcohol concentration (BAC) is 0.08 or higher or their mental or physical faculties are impaired due to the use of a controlled substance.

Penalties for a DWI Conviction
Below are the basic penalties for DWI in the state of Texas.
First Offense DWI
First-offense DWI is a Class B Misdemeanor. Penalties for a first-offense DWI include a fine of up to $2,000, up to 180 days in jail, and loss of your driver's license for up to a year. An ignition interlock device (IID) will need to be installed in your vehicle if you want an occupational license.
Second Offense DWI
Second-offense DWI is a Class A Misdemeanor. Penalties for a second-offense DWI include a fine of up to $4,000, up to one year in jail, and loss of your driver's license for up to two years. An ignition interlock device will need to be installed in any vehicle you drive.
Third Offense or Higher DWI
A third DWI charge is a third-degree felony. Penalties for a third-or-higher DWI offense include a fine of up to $10,000, up to 10 years in prison, and loss of your driver's license for up to two years. An ignition interlock device will need to be installed in any vehicle you drive.
There Is No Lookback Period
Texas has no lookback period when it comes to DWI. That means you can be charged with a second DWI offense in the state even if the first DWI conviction took place 25 years ago.
Highlighted Not Guilty Verdict: Driving While Intoxicated BAC ≥ 0.15
In October 2019, Jason L. Trumpler represented a client who police found passed out in her vehicle with the engine running. Her BAC was 0.201/0.203.

DWI with a 0.15 or Higher BAC
While intoxication begins at a BAC of 0.08, there are more serious legal consequences if you're found with a higher BAC. A DWI with a BAC of 0.15 or greater is a Class A Misdemeanor and carries much stricter criminal penalties than a normal first-offense DWI.

Underage Intoxicated Driving
It is illegal for anyone under the of 21 to consume alcohol in the state of Texas. If a minor operates a vehicle while intoxicated, they can be charged with driving under the influence of alcohol by a minor (DUIA).
Zero Tolerance Rules
A person under 21 can be charged with DUIA if there is any traceable amount of alcohol in their system.
Penalties for DUIA
For minors under the age of 17, a first offense DUIA is a Class C Misdemeanor. Penalties include a fine of up to $500, up to 40 hours of community service, and a license suspension of at least 60 days.
For minors age 17-20, a first offense DUIA is a Class B Misdemeanor. Penalties include a fine of up to $2,000, up to 180 days in jail, and a license suspension of at least one year.
Keep in mind that minors can be charged with both DUIA and DWI.
DWI With a Minor in the Car
In Texas, it is a state felony to operate a vehicle while intoxicated with a passenger who is younger than 15. Penalties for this offense include up to two years in jail and a fine of up to $10,000.

You can be charged with reckless damage or destruction if you caused an auto accident that resulted in damage to another person's property. This is a Class C Misdemeanor that carries its own legal penalties on top of a DWI charge.
