In Texas, a person is legally intoxicated when their blood alcohol concentration (BAC) is 0.08 or higher or their mental or physical faculties are impaired due to the use of a controlled substance.

DWI With a BAC Of .15 or Higher

While intoxication begins at a BAC of 0.08, there are more serious legal consequences if you're found with a higher BAC. A DWI with a BAC of 0.15 or greater is a Class A Misdemeanor and carries much stricter criminal penalties than a normal first-offense DWI.

Highlighted Not Guilty Verdict: Driving While Intoxicated BAC ≥ 0.15

In October 2019, Jason L. Trumpler represented a client who police found passed out in her vehicle with the engine running. Her BAC was 0.201/0.203.

Thanks to his years spent as a prosecutor, Mr. Trumpler suspected that there could be more to the story. During the trial, Mr. Trumpler pointed out that the officers who found his client immediately jumped to conclusions about what had happened rather than carrying out an investigation to establish the facts.

The jury found Mr. Trumpler's client not guilty, which spared her severe fines and other legal penalties.

The takeaway: Mr. Trumpler strives to ensure his clients get to tell their side of the story.

Mr. Trumpler Can Defend Commercial Drivers

Texas has the most commercial truck drivers of any state in America, with over 200,000 Texans employed as big rig drivers. A commercial driver who is charged with DWI is subject to more strict laws than a typical civilian driver. They also often face more damaging consequences, since a DWI conviction can directly imperil their ability to work.

In Texas, the BAC threshold for a typical DWI is .08. When it comes to operating a commercial vehicle, the legal BAC limit is just .04.

If you are convicted of a first-offense DWI while driving a commercial vehicle, you are subject to a CDL suspension of at least one year. A DWI while transporting hazardous materials can result in a three-year license disqualification. A second offense for either of these can directly lead to a lifetime CDL suspension.

As you can see, Texas takes commercial DWI very seriously. If you need to defend your life and livelihood from such charges, Mr. Trumpler can do everything in his power to protect you.

Clean Your Criminal Record

  • Expunction - Also known as expungement, expunction will completely remove an offense from your criminal record.
  • Nondisclosure - Nondisclosure seals select offenses in your criminal record from public view by most parties, including employers and lenders.
