First Offense DWI

First-offense DWI is a Class B misdemeanor. Penalties for a first-offense DWI include a fine of up to $2,000, up to 180 days in jail, and loss of your driver's license for up to a year. While intoxication begins at a BAC of 0.08, there are more serious legal consequences if you're found with a higher BAC. A DWI with a BAC of 0.15 or greater is a Class A Misdemeanor and carries much stricter criminal penalties than a normal first-offense DWI.

Underage Intoxicated Driving

It is illegal for anyone under the of 21 to consume alcohol in the state of Texas. If a minor operates a vehicle while intoxicated, they can be charged with driving under the influence of alcohol (DUIA) by a minor.

Zero Tolerance Rules

A person under 21 can be charged with DUIA if there is any traceable amount of alcohol in their system.

Penalties for DUIA

For minors under the age of 17, a first offense DUIA is a Class C Misdemeanor. Penalties include a fine of up to $500, up to 40 hours of community service, and a license suspension of at least 60 days.

For minors age 17–20, a first offense DUIA is a Class B Misdemeanor. Penalties include a fine of up to $2,000, up to 180 days in jail, and a license suspension of at least one year.

Keep in mind that minors can be charged with both DUIA and DWI.

In Texas, it is a state felony to operate a vehicle while intoxicated with a passenger who is younger than 15. Penalties for this offense include up to two years in jail and a fine of up to $10,000.
