A person commits the offense of indecent exposure if he or she exposes his anus or any part of his genitals with intent to arouse or gratify the sexual desire of any person, and he or she is reckless about whether another is present who will be offended or alarmed by his act.  The offender must act “recklessly,” meaning that the act was not solicited and was lacking in consent. An important aspect of indecent exposure is the lack of physical contact – if an individual makes some sort of physical contact with his or her genitals, then sexual assault or assault charges might be brought forth instead. Additionally, it is important to note that in order to file an indecent exposure charge, intent to arouse or gratify sexual desire must be present. Therefore, it is erroneous to charge an individual defecating in public with indecent exposure as people who are urinating or defecating in public typically do not do so with the intent to sexually arouse another person.  In addition, folks who are just wandering nude without sexual intent should not get charged with this crime.

Typically, an indecent exposure conviction is a Class B Misdemeanor. An indecent exposure conviction on your record can be very damaging. A conviction will appear on future employment and housing background checks. A Class B Misdemeanor carries with it:
Up to 180 days in the county jail.
Up to a $2,000 fine or both jail and fine.
