Assault is one of the most common charges we see at our Austin, TX, law firm. If you intentionally or recklessly caused another person or a spouse's bodily harm, you can be charged. Deadly Conduct

Under Texas's Penal Code § 22.05, a defendant can be charged with deadly conduct if they engage in activity that places another person or spouse in imminent danger of a serious injury or if the defendant fires a deadly weapon in the direction of another party. While the first scenario is a Class A misdemeanor, the second is a felony in the third degree.

Terroristic Threat

Under Texas's Penal Code § 22.07, a terroristic threat is defined as a threat of violence towards a person or property that is designed to cause a reaction from emergency personnel or agencies, make others believe that they are in serious danger of bodily injury, and other similar situations.

Deadly Force in Defense of Person

There are some situations in which deadly force against another person or party is warranted. Per Texas Penal Code 9.32, deadly force may be necessary when an individual feels that there is a threat of unlawful deadly force against them or if they are preventing the other person from committing kidnap, murder, sex crimes, or robbery.

Deadly Force to Protect Property

If you had to use force to protect your property from trespassers or unlawful interference, the law is also on your side. Texas law protects people who had no other choice but to use force to prevent trespassing, arson, burglary, and other criminal actions.
