Domestic Violence Lawyer

A domestic violence case against you can have serious and lifelong repercussions, even if you have been wrongly or incorrectly accused.

Domestic violence lawyer Jason Trumpler can help you reach the best possible resolution if you are being charged with family violence.

Our attorney has helped many defendants at our Round Rock and Austin, TX, offices protect their best interests in these matters.

Hiring a Domestic Violence Lawyer Can Help Protect Your:

Family Structure

Domestic violence charges can bring about restraining orders and unfavorable child custody agreements. With a restraining order against you, it can be difficult to spend time with your children and other family members. A domestic violence lawyer can examine the facts of your case and determine whether the restraining order or custody agreements are warranted.

Employment Opportunities

A family violence conviction can affect your current and future job prospects because with a criminal record, it can be more difficult to obtain certain licenses, certifications, or job roles. Hiring a domestic violence attorney is the best way to ensure that your reputation remains intact and that you remain employable.

If you are convicted, your sentence can include imprisonment, probation, or a permanent criminal record. A criminal record can affect your constitutional rights, including your ability to own a firearm. A domestic violence lawyer like Jason Trumpler can examine the facts of your case and help you get your charges reduced or dismissed so that you can continue living the life you enjoy.

Our Lawyer Defends the Military

Jason Trumpler defends any Texan needing a lawyer who knows how to get damaging domestic violence charges reduced or dismissed. In one of his most notable domestic violence wins, Mr. Trumpler took on the case of a Fort Hood military sergeant who was charged with two serious crimes: assault with a deadly weapon on a girlfriend and two domestic violence issues.

Our attorney analyzed all case details and devised a successful strategy. His persuasive legal arguments led to one of the charges being eliminated at the Article 32 Hearing. He was then able to get the remaining charges dismissed, allowing his client to leave the military with a general discharge that kept his VA benefits intact.

What Is Domestic Violence?

Sad woman

In the state of Texas, domestic assault is defined as intentionally, knowingly, or recklessly causing bodily injury to another person in your household or family. A reckless act could include unintentional injury caused by the simple act of pushing someone aside. It can also include viable threats of physical harm.

According to the Texas Family Code, family violence is:

  • An act of physical harm, injury, assault, or abuse by one member of a family or household that places another member in serious danger
  • A threat that places a member of the family in fear of real physical harm
  • Physical contact that is provocative or offensive to someone that the offender knows
  • An act of sexual assault or physical contact known to be provocative or offensive (including sexual touching or invading personal space)
  • Child abuse (not including the reasonable discipline of a child) including abuse in the form of physical harm, genuine threats, sexual abuse, or sexual misconduct
  • Dating violence, or abuse between two individuals who have or have had a romantic or intimate relationship

Various Parties Can Be Involved in a Family Violence Case

In Texas, domestic violence is more commonly known as family violence, but it encompasses more than just family members. Domestic violence charges can also involve someone with whom you share a past or present relationship, or even an unrelated member of the household. The family members involved can include:

  • Current spouses
  • Former spouses
  • Children of current or former spouses
  • Foster children
  • Foster parents
  • Any person residing in the same household
  • Any person with whom you have had an intimate relationship in the past

The possible consequences are the same in every case.

Were You  Defending Yourself?

It is important to note that family violence does not include any defensive acts to protect oneself. If you were accused of family violence after trying to protect yourself, contact our Austin law office today to have the best possible chances of telling your side of the story and clearing your name.

Other Potential Defense Strategies

As a former prosecutor, criminal defense lawyer Jason Trumpler understands both sides of every domestic violence case and can help you develop a strong defense. In some cases, the prosecution can drop the case if our firm is able to show:

Lack of Injuries

Injuries are among the strongest evidence. If your accuser is unable to demonstrate that you caused any injuries, they will have a difficult time demonstrating that family violence occurred in the first place.

Bad Evidence

If the accuser demonstrates disputable or insufficient evidence, our criminal defense lawyer can highlight these deficiencies to help your case.

Ill Will from the Accuser

In some cases, the accuser presses domestic violence charges because they are seeking revenge against you. Our team will study all of the history and facts involved in your case to determine whether the accuser is filing charges to defame you or hurt you.

Mutual Violence

If both sides acted violently towards each other, our lawyer can help you build a strong case that protects your innocence.

Our domestic violence lawyer can also prove that you unintentionally or mistakenly performed an act that was deemed offensive or provocative by your accuser.

In order to prove that you are guilty, the prosecuting side will have to prove "beyond reasonable doubt" that you knowingly and willingly performed the act you are being accused of. Our team can compile the most relevant facts to build a strong defense that protects your innocence.

False Allegations Happen We Don't Hesitate to Fight Them

In 2023, the Coalition to End Domestic Violence reported on a survey of over 1,200 American adults, finding that a full 10% of respondents felt they'd been falsely accused of domestic abuse. If you are facing false allegations, know you are not the first person to deal with this kind of situation and that our attorney knows how to stand up for clients facing egregious charges.

Other Types of Domestic Violence Cases

Man in handcuffs

Besides domestic assault, there are two more serious forms of domestic violence cases:

Aggravated Domestic Assault

Aggravated domestic assault results in serious bodily injury. Use of a deadly weapon also brings an aggravated domestic assault charge, which can be a first- or second-degree felony.

Continuous Violence

If a defendant is found to have committed two domestic assaults in a 12-month period, this can bring a charge of continuous violence, a third-degree felony. However, you can be charged with a third-degree felony regardless of whether you were arrested for or convicted of prior assault. For this reason alone, it is important to seek legal counsel for any charge of domestic violence.

Benefits of Hiring a Domestic Violence Lawyer Like Jason Trumpler

Recent Legal Changes
Give Accusers More Time to Seek Charges

Texas used to provide domestic violence accusers a maximum of three years from the date of an alleged incident to seek the filing of charges. In 2023, House Bill 467 went into effect, extending the amount of time an accuser has to levy their allegation. Now, a felony domestic violence case can be filed a full five years after the alleged incident.

If someone you used to have a relationship with years ago is now all of a sudden accusing you of domestic violence, this is not something to be taken lightly. Due to this new bill, they may be able to have you arrested and even imprisoned despite having had no relationship with you for almost half a decade. If you live in Round Rock or another part of Williamson County and find yourself in a situation like this, reach out to Mr. Trumpler now.
