Behavior that is simply annoying, like calling someone’s phone over and over again, while possibly crimininal, does not constitute the felony offense of stalking.  Stalking is defined as harassing behavior that causes an individual to genuinely fear for his or her safety. Additionally, the stalking behavior must be repeated (occur more than once), be directed at a specific individual, and cause that individual to fear that his or her life or the life of a romantic partner may be in danger.

Stalking is a felony of the 3rd Degree. If you are convicted of stalking, potential repercussions may include:

2 – 10-years in prison and/or
A fine of up to $10,000

If you have previous stalking convictions on your background, the charge may be enhanced to a felony of the 2nd Degree. If you are convicted on a 2nd Degree felony, potential repercussions may include:

• 2 – 20-years in prison and/or
• A fine of up to $10,000
